In 2023, customs officers of the Tver region initiated 239 cases of administrative offenses

In 2023, customs officers of the Tver region initiated 239 cases of administrative offenses (AA), including 42 cases of AA initiated by the Smolensk Customs Service in the Tver region (hereinafter – the Service), and 197 cases of AA initiated by customs posts located in the Tver region. The amount of fines imposed on violators of customs legislation amounted to over 7 million rubles

“During this period, the service considered 301 cases of violation of customs law, imposed fines of over 6.7 million rubles,   of which more than 3.6 million rubles recovered. The courts considered 28 cases of violation of law, imposed fines in the amount of 300 thousand rubles, confiscated goods worth more than 28 million rubles,” – said Deputy Head of Customs – Head of the Smolensk Customs Service for the Tver region Alexander Osipov.

The violations detected relate to:

– reporting false information about goods to the customs authority (3 cases of violation under part 3 of article 16.1 of the Administrative Offenses Code of the Russian Federation);

– non-declaration and non-declaration of goods (3 cases of violation under part 3 of article 16.1 of the Administrative Offenses Code of the Russian Federation);

– non-declaration and false declaration of goods (16 cases under Article 16.2 of the Administrative Offenses Code of the Russian Federation);

– failure to comply with prohibitions and (or) restrictions on the importation of goods into the customs territory (6 cases under Article 16.3 of the Code of Administrative Offenses of the Russian Federation);

– failure to declare goods (16 cases under Article 16.2 of the Code of Administrative Offenses of the Russian Federation)

– failure to submit to the customs authority statistical forms for recording the movement of goods (166 cases of violation of Article 19.7.13 of the Administrative Offenses Code of the Russian Federation);

– failure to provide documents and information required for customs control within the time limit established by the customs authority (4 cases of violation under part 3 of article 16.12 of the Code of Administrative Offenses of the Russian Federation);

– violation of the procedure for placing goods in the customs office (4 cases of violation under part 3 of article 16.12 of the Code of Administrative Offenses of the Russian Federation);

– violation of the procedure for placing goods in storage, the procedure for their storage or the procedure for performing operations with them (4 cases of violation under Article 16.14 of the Code of Administrative Offenses of the Russian Federation);

– violation of the procedure for placing goods in storage, the procedure for their storage or the procedure for performing operations with them (4 cases of violation under Article 16.14 of the Code of Administrative Offenses of the Russian Federation);

– failure to submit reports to the customs authority (5 cases of violation under article 16.15 of the Code of Administrative Offenses of the Russian Federation);

– failure to pay administrative fees to the customs authority

– failure to pay an administrative fine within the time limit stipulated by law (6 cases of administrative fines under part 1 of article 20.25 of the Code of Administrative Offenses of the Russian Federation);

– failure to comply with the procedure for paying an administrative fine within the time limit stipulated by law

– failure to comply with the customs transit procedure (28 cases of violation under article 16.10, article 16.11, part 1 of article 16.9, article 16.6 of the Code of Administrative Offences of the Russian Federation);

– non-importation or non-implementation of re-importation of goods and (or) means of transportation by individuals (1 case on AP  under part 1 of article 16.18 of the CAO RF)

It should be noted that 69% of all identified violations are violations related to the failure to submit or late submission to the customs authority of statistical forms for the movement of goods in the framework of mutual trade with the EAEU countries, or submission of statistical forms containing inaccurate information

Smolensk Customs urges organizations and entrepreneurs registered with the tax authorities of the Tver region and moving goods within the framework of mutual trade with the EAEU countries to submit statistical forms to the Customs in a reliable and timely manner, which will avoid unnecessary financial costs.
