Bryansk customs: the persons engaged in the movement of goods in mutual trade with member States of the Eurasian economic Union
Bryansk customs informs that on 29 January 2017 entered into force amendments to articles 12 and 104 № 311-FZ “On customs regulation in the Russian Federation” and amendments to article 19.7 of the administrative code “Failure to submit or late submission to the customs authorities of statistical forms of the account of movement of goods”.
According to the amendments, failure to submit or late submission to the customs authorities of statistical forms of the account of movement of goods, or the submission of statistical forms containing false information, is now punishable by an administrative penalty on officials in the amount from 10 to 15 thousand rubles; on legal entities – from 20 to 50 thousand rubles.
Re-committing an administrative offense, punishable by an administrative fine on officials in the amount from 20 to 30 thousand rubles; on legal entities – from 50 to 100 thousand rubles.
Individual entrepreneurs are liable on a par with legal entities.
The person is released from administrative liability for violation of the article 19.7.13, in the case of voluntary, timely (prior to the detection by customs authorities of the offence) the submission to the customs authority of the Declaration of cancellation of the statistical form containing false information, with the simultaneous introduction of the new statistical forms with accurate information.
The statistical form of the account of movement of goods is populated on the website of the FCS of Russia. In electronic form it can be submitted via personal Cabinet of the participant of foreign economic activity on the same site. On paper the statistical form is served personally or sent by post to the customs body in the region of the applicant consists on the account in tax service.
The statistical form is submitted to the customs authority in the region of the applicant consists on the account in tax body in accordance with the legislation of the Russian Federation on taxes and fees, no later than the 8th working day of the month following the month in which the goods are shipped from the warehouse or receiving items at the warehouse.
Bryansk customs draws the attention of applicants, guides, statistical forms on paper that perhaps in the near future the only way to submit a statistical form will be an electronic document generated using the digital signature and the hard copies a thing of the past. Information on relevant changes to be made in the current order, posted on the official website of FCS of Russia.
Persons using electronic signature, receive a number of benefits associated with submission of data on mutual trade with member States of the EEU. Such as:
the statistical form is submitted only as an electronic document. The date of submission of statistical forms shall be the date of sending the electronic document through information-telecommunication network “Internet”;
– there is no need to duplicate information on paper.
– receive registration number of statistical forms within one minute;
– the possibility of cancellation in case of detection of the information incorrectly represented in statistical form, without the filing on paper.
– simplify and accelerate the application of information about the mutual trade between the customs authorities and banking institutions.
For the approval of statistical forms traders can use the same electronic signature used when declaring goods in electronic form with the countries of far abroad and CIS countries outside the EEU.
The electronic signature certifies the completeness and accuracy of the information submitted by the applicant. To obtain an electronic signature is a trader can in the departmental certifying center of the customs authorities or trusted certification centers authorized by the Federal customs service of Russia to issue qualified certificates of keys of check of digital signatures.
Help. For 5 months 2020 participants in mutual trade in the Bryansk customs office was 10 608 statistical forms, which is 9.5 % less than in the same period of 2019 (11 728 statistical forms).
With the use of electronic signatures was 7 996 statistical forms, which is 75.4 % of the total number of registered statistical forms.
For violations of the law related to failure to submit or untimely submission to customs authorities of statistical forms of the account of movement of goods instituted 208 cases of administrative offense under article 19.7.13 administrative code. The amount of the fine amounted to 916 thousand rubles.
