Siberian customs Department informs about provision of privileges on payment of customs duties and taxes in respect of goods imported into the customs territory of the Eurasian economic Union in order to implement the member States of the Eurasian economic Union measures aimed at the prevention and prevention of the spread of coronavirus infections 2019-nCoV

The decision of the Board Eurasian economic Commission of 16.03.2020 № 21 “On amendments to some decisions of the Customs Union Commission and on approval of list of goods imported into the customs territory of the Eurasian economic Union in order to implement the member States of the Eurasian economic Union measures aimed at the prevention and prevention of the spread of coronavirus infections 2019-nCoV” (hereinafter – the Decision) in respect of goods specified in the Annex to this Decision, provides for the granting of benefits on payment of import duties when they are placed under the customs procedure of release for domestic consumption.

This privilege is granted upon registration of the goods Declaration for placing them under the customs procedure of release for domestic consumption 30.09.2020 including the submission to the customs authorities of the member States confirm the target destination of the imported goods, issued by the authorized healthcare Executive authority of the member state or other authorized bodies of Executive power of a member state containing the item details, quantity, value of such goods and on the organizations engaged in the importation.

For the purposes of the List, approved by the Decision should be guided by the code of the commodity nomenclature of foreign economic activity of the Eurasian economic Union (hereinafter – CN FEA EAEU) and the name of the product.

This Decision entered into force 03.04.2020 and applies to legal relations arising from 16.03.2020.

The government of the Russian Federation from 02.04.2020 № 419 “On the implementation of the decisions of the Council of the Eurasian economic Commission 16.03.2020 No. 21 amendments to the List of medical goods, which realisation in territory of the Russian Federation and whose import into the territory of the Russian Federation and other territories under its jurisdiction not taxable (exempt from taxation) with value-added tax” (hereinafter – Decree № 419) (entered into force 06.04.2020, apply to relations arising from 16.03.2020) a List of the medical supplies the implementation of which on the territory of the Russian Federation and imported into the territory of the Russian Federation and other territories under its jurisdiction not taxable (exempt from taxation) with value-added tax (hereinafter – the List), approved by the Decree of the Government of the Russian Federation from 30.09.2015 No. 1042, supplemented by Chapter V, “Medical goods for prevention and prevent the spread of novel coronavirus infection (2019-nCoV)”.

According to note 3 for the purposes of the application of section V of the Checklist should be guided by the codes of FEACN of the cu and the name of the product with reference to appropriate code according to the classification of products (OKP) OK 005-93 or (JECFA 2) OK 034-2014 subject to the submission of the document on confirmation of the purpose, issued by the authorized Executive body of state power of subjects of the Russian Federation, confirming further transfer of goods free of charge to non-profit organizations operating in the sphere of health protection, including medical health care institutions (indicating the document on confirmation of the target destination name of the person importing products (including addresses and taxpayer identification numbers), names of nonprofit organizations operating in the sphere of health protection, including medical health facilities, which are subject to the transfer of goods (including addresses and taxpayer identification numbers), names of the transferred goods, their value, quantity and codes on the classification of products JECFA 2 and (or) the FEACN of the cu, the period within which the goods shall be the further transmission).

Document, confirming the target of the assignment is signed by an authorized officer of the authorized Executive body of state power of a subject of the Russian Federation indicating the date of the signature and the affixing of the seal of the established sample of the authorized Executive body of state power of a subject of the Russian Federation, and it is also sent to the applicant and to the Federal customs service within one working day after its signing.
