Rostov customs officers uncovered a “fake” director of a Don company

In the course of checking the activities of a Don firm involved in foreign economic activity, customs officers found that its director was a front man.

In March 2023, a resident of Rostov-on-Don offered an acquaintance to use his passport to enter information about him as the director of the firm into the Unified State Register of Legal Entities. She then persuaded the founder of the firm to appoint him as a new director and submitted documents to make changes to the unified state register of legal entities. The woman did all this in collusion with a group of persons in order to conceal further criminal activity on behalf of the firm

The citizen did not actually intend to carry out any administrative functions and financial and economic activities in relation to the firm

Rostov Customs initiated criminal proceedings under point “B” part 2 of article 173.1 of the Criminal Code of the Russian Federation – formation (creation, reorganization) of a legal entity through front persons, as well as submission of data to the body carrying out state registration of legal entities and individual entrepreneurs by a group of persons by prior agreement, which led to the introduction of information on front persons into the Unified State Register of Legal Entities.

After the investigation was completed, the criminal proceedings were initiated

After carrying out urgent investigative actions, the criminal case was transferred under investigation

Inquiry: Part 2 of Article 173.1 of the Criminal Code of the Russian Federation prescribes punishment in the form of a fine in the amount of three hundred thousand to five hundred thousand rubles or in the amount of wages or other income of the convicted person for a period of one to three years, or compulsory labor for a term of one hundred eighty to two hundred forty hours, or imprisonment for a term of up to five years
