Saratov customs: confiscated 3,500 packets of cigarettes bisecting

Saratov customs office opened a case on an administrative offense under article 16.3 of the administrative code of the Russian Federation with bringing the citizen of Russia into the customs territory of the Russian Federation from the Republic of Kazakhstan 3500 packs of cigarettes (“FAST 10”-1000 packs “PRESTIGE”-1000 packs “MM” – 1000 packs “FORMAN”-500 packs) manufacturing countries of Europe and the UK without special (excise) stamps of the Russian Federation.

Specified tobacco products seized by employees of the Saratov customs as material evidence in the case. According to expert opinion, the total market value of the seized cigarettes is 248805 rubles.

Saratov customs on this fact was the crime report (submitted by jurisdiction in OMVD Russia’s Ozinsky area of the Saratov region) on the grounds of part 5 of article 171 of the criminal code (acquisition, storage, transportation for sale of unmarked tobacco products subject to marking special (excise) marks, committed in large amount).

According to article 4 of the Federal law of 22.12.2008 № 268-FZ “Technical regulations on tobacco products”, tobacco products are subject to marking with special (excise) stamps. Realisation in territory of the Russian Federation of tobacco products without the marking of special (excise) stamps are not allowed.

In accordance with the decree of the Government of the Russian Federation dated 20.02.2010 № 76 “On excise stamps for labeling of imported into the customs territory of the Russian Federation of tobacco products,” since 01.01.2011 it is prohibited to import on customs territory of the Russian Federation of tobacco products without excise stamps marking in accordance with this decision.
