More than 22,000 of the statistical forms was presented by the participants of foreign economic activity in the Rostov customs in 2019
In accordance with the current legislation of the Russian Federation foreign trade operators engaged in commercial operations with the member States of the EEU, it is necessary to submit to customs authorities of statistical forms of the account of movement of goods. Violation of this requirement leads to attraction to administrative responsibility according to art 19.7.13 administrative code.
The procedure and deadlines for submission of statistical forms of the account of movement of goods in mutual trade of the Russian Federation with member States of the EAEC (hereinafter – statistical form) to the customs authorities established by the government of the Russian Federation from 07.12.2015 № 1329 “On the organization of statistics of mutual trade of the Russian Federation with member States of the Eurasian economic Union”.
The statistical form is submitted to the customs body in the region of the applicant consists on the account in tax body in accordance with the legislation of the Russian Federation on taxes and fees, no later than the 8th working day of the month following the month in which the goods are shipped from the warehouse or receiving items at the warehouse.
In accordance with part 1 of article 19.7.13 administrative code failure to submit or late submission to the customs authorities of statistical forms of the account of movement of goods or the submission of statistical forms of the account of movement of goods containing inaccurate information, shall entail the imposition of an administrative fine on officials in the amount from ten thousand to fifteen thousand roubles; on juridical persons – from twenty thousand to fifty thousand roubles.
In accordance with part 2 of article 19.7.13 administrative code of re-committing an administrative offense under part 1 of article 19.7.13 administrative code, shall entail the imposition of an administrative fine on officials in the amount from twenty thousand to thirty thousand rubles; on legal entities – from fifty thousand to hundred thousand roubles.
So in 2019, the Rostov customs has opened more than 500 cases of AP
according to the article 19.7.13 administrative code (in 2018 this figure was twice as much).
According to the statistics Department’s head of the Rostov customs Andrey Small: “the Process of filling and submission of statistical forms to the customs authorities is quite simple. Filling in statistical forms is on the official website of the FCS of Russia www.customs.ru in the personal Cabinet of the participant of foreign trade activities, which also posted detailed instructions for the order of its filling. Statistical form may be filed to the customs authority one of the following ways: on paper certified by the applicant’s signature and company seal, either in electronic form using an electronic signature. It should be noted that for filling in the statistical form FEA participant may use the electronic signature used in the Commission of customs operations in electronic form, either when reporting to the tax authority”.
Last year customs, there were more than 22 000 statistical forms. However, significantly decreased the number of violations of the law related to failure to submit or late submission of forms.”
