Attention immigrants: when moving personal belongings across the border you must comply with the customs legislation

The Yaroslavl customs recalls the observance of the rules of movement of goods and vehicles across the customs border for natural persons relocating for permanent residence in the Russian Federation.

Currently, the list of cases and conditions of importation into the customs territory of the Eurasian economic Union (EEU) of goods for personal use with exemption from customs duties, taxes, law established by Annex 3 to the decision of the Board Eurasian economic Commission of December 20, 2017 No. 107.

A foreign natural person who has been moved to permanent residence in the Russian Federation and received the status of refugee, forced migrant, may import to the customs territory of the EAEU in any way with the exemption from customs duties and taxes:

a) used goods for personal use subject to simultaneous observance of following conditions:

– the importation into the customs territory of the EAEU from the country of previous residence is within 18 months from the date of issue of the document confirming the recognition of foreign individuals who moved to permanent residence in the Russian Federation or a document confirming the receipt by such person of the status of the refugee, forced migrant, in accordance with the legislation of the Russian Federation;

– goods for personal use acquired before the date of issue of the document confirming the recognition of foreign individuals who moved to permanent residence in the Russian Federation or a document confirming the receipt by such person of the status of the refugee, forced migrant, in accordance with the legislation of the Russian Federation;

– such person has not previously been imported into the customs territory of the EAEU of goods for personal use with exemption from customs duties, taxes in connection with the recognition of him who moved for permanent residence in the Russian Federation or the refugee, forced migrant, in accordance with the legislation of the Russian Federation;

b) auto – and motor transport means and trailers to cars and motor vehicles, which are vehicles for personal use, not more than 1 unit of each type, while respecting the following conditions:

– the importation into the customs territory of the EAEU from the country of previous residence is within 18 months from the date of issue of the document confirming the recognition of foreign individuals who moved to permanent residence in the Russian Federation or a document confirming the receipt by such person of the status of the refugee, forced migrant, in accordance with the legislation of the Russian Federation;

auto and motor vehicles, trailers for cars and motor vehicles, which are vehicles for personal use owned and was registered in a foreign physical person who has been moved to permanent residence in a member state of the EEU or granted the status of refugee, forced migrant, the country of previous residence for at least 6 months, or a hard deadline set by the legislation of the state member (in accordance with part 6 of article 190 of the Federal law from 03.08.2018 No. 289-FZ set a period of not less than 12 months), prior to the date of issuing the document confirming a recognition of such foreign individuals to move to permanent residence in a member state of the EAEC, or a document confirming the receipt of such person of the status of the refugee, forced migrant, in accordance with the laws of the member States of the EAEU;

– such person has not previously been imported into the customs territory of the EAEU of auto and motor transport, trailers for cars and motor vehicles, which are vehicles for personal use, with exemption from customs duties, taxes in connection with the recognition of him who moved for permanent residence in the Russian Federation or the refugee, forced migrant, in accordance with the legislation of the Russian Federation.

Taking into account the specific normative document in which a person can exercise their right to return to the Russian Federation, the following documents, confirming the recognition of persons arriving (moving) to permanent residence in the Russian Federation as a member state of the Customs Union:

– a certificate of participant of the State program on rendering assistance to voluntary resettlement to Russian Federation of compatriots residing abroad (decree of the President of the Russian Federation of 22 June 2006 № 637);

– the identity of the immigrant, in the framework of the international treaties of the Russian Federation on regulation of process of resettlement and protection of the rights of immigrants – permit for relocation (moving);

– the residence permit stipulated by the Federal law of 25 July 2002 № 115-FZ “On legal status of foreign citizens in the Russian Federation” (for those not relocating within the state program on assisting the voluntary resettlement in Russia of compatriots living abroad).

In addition, such documents may include documents confirming acquisition of citizenship of the Russian Federation, followed by getting a permanent registration at the place of residence in the Russian Federation.

Please also note that as a prerequisite for registration of vehicles and their tolerance to participation in traffic, is the availability of passports of vehicles, which are issued by the customs authorities in case of compliance of the vehicle with the requirements of technical regulations on safety of wheeled vehicles and the scrappage fee (with the exception of cases set forth in paragraph 6 of article 24.1 of the Federal law of 24.06.1998 №89-FZ).

For the first quarter of 2020 in the Yaroslavl customs turned 20 foreign citizens who dared to move to the Yaroslavl region. All they were interested in the movement across the customs border of vehicles and goods for personal needs and provided benefits.
