A criminal case for excess of powers of office

In relation to the chief state customs inspector of Department of customs control after release of goods of Bashkortostan customs of the Ufa investigatory Department of Privolzhsky investigatory management on transport of SK of Russia brought criminal case on signs of the crime provided by part 1 of article 286 of the RF criminal code (exceeding official powers).

Officer of customs, as a member of the Commission to conduct the customs inspection in respect of the company – participant of foreign trade activities on the question of the validity of the statements in the Declaration of goods information on the classification code imported from abroad of goods, passed on to the Director of the enterprise data on progress and further planning for the audit in respect of his organization and advised him about how it is possible to avoid the payment of customs duties in connection with the change of the classification code of goods, as well as what you need to perform actions to avoid administrative and criminal liability. However, by their actions, the main state customs inspector could not affect the results of testing.

The results of the test has been assessed that more than 6.6 million rubles of customs payments in respect of the IEA initiated a case on administrative offence, and in respect of the Director criminal case on the fact of evasion from payment of customs payments, which is currently pending in court.
