The Dagestani customs reminds of the responsibility for the illegal movement across the customs border of the EEU potent substances

The customs legislation of the Eurasian economic Union (hereinafter EAEC), regulating in particular the procedure for moving through customs border of goods by individuals for personal use, provides value, weight and (or) quantitative rules within which the goods for personal use may be imported into the customs territory of the Eurasian economic Union without payment of customs duties and taxes.

In accordance with the Decision of the Board Eurasian economic Commission of December 20, 2017 No. 107 “On certain issues related to goods for personal use”, such goods include:

  1. goods for personal use (except for ethyl alcohol, alcoholic beverages, beer and indivisible goods for personal use), imported in accompanied and (or) unaccompanied baggage air transport mode, the value of which does not exceed an amount equivalent 10 000 euros and (or) the weight does not exceed 50 kg;
  2. tobacco and tobacco products, imported in accompanied and (or) unaccompanied baggage by any mode of transport, in the amount of 200 cigarettes, or 50 cigars (cigarillos) or 250 grams of tobacco or specified products in assortment with the total weight not exceeding 250 grams per one person over 18 years of age;
  3. goods for personal use (except for ethyl alcohol, alcoholic beverages, beer and indivisible goods for personal use), imported in accompanied and (or) unaccompanied baggage types of transport other than by air or on foot, the cost does not exceed the equivalent of 500 euros, and (or) weight less than 25 kg.;
  4. goods for personal use (except for ethyl alcohol, alcoholic beverages, beer and indivisible goods for personal use), delivered by the carrier to the customs territory of the Eurasian economic Union, the cost of which does not exceed an amount equivalent to 200 euros, and (or) weight of 31 kg.;
  5. goods for personal use (except for indivisible goods for personal use) sent by international mail to the customs territory of the EAEU, the cost of which does not exceed an amount equivalent to 200 euros, and (or) gross weight of international postal items not exceeding 31 kg;

6.Alcoholic drinks and beer, imported in accompanied and (or) unaccompanied baggage in the amount of 3 liters per one person over 18 years of age.

In the recent increase in the facts of moving by physical persons through the customs border of the EAEC, under the guise of goods for personal use of tobacco and tobacco products in excess of the above norms.

Often, the person moving such goods exceeding that prescribed by the Decision of the Board Eurasian economic Commission of December 20, 2017 No. 107 “On certain issues related to goods for personal use” quantity, not even aware of the problems that they encounter in the course of customs control when crossing the customs border, because of data violations of the current legislation of the Russian Federation provides responsibility, including criminal.

So, if the cost moved without customs Declaration of alcohol and (or) tobacco products exceeds two hundred fifty thousand rubles (minus the cost of that part of the value of goods which the customs legislation of the Customs Union are allowed to travel without declaring and (or) was declared), persons illegally moved the goods, shall bear criminal responsibility according to article 200.2 of the Criminal code of the Russian Federation in the form of a fine from three hundred thousand to one million rubles or the salary or other income for a period of one year to three years compulsory labor for a term not exceeding five years, or imprisonment for the same term.

For example, in 2019 the Dagestan customs office filed two criminal cases on the facts of illegal movement across the customs border of the EAEU from the Republic of Azerbaijan tobacco products: Smoking mixtures in the amount of 998 kg per сумму1 469502 rubles and cigarettes of the brand “КING” in the amount of 10,000 packs 670491 value of 1 ruble.

Starting in 2020, on the fact of illegal movement through customs border of the EAEU from the Republic of Azerbaijan tobacco products (hookah Smoking mixtures in the amount of 135 kg, worth 323 304рублей)one criminal case.

We believe it is necessary to additionally draw the attention of individuals who buy goods abroad and moving them across the customs border of the Eurasian economic Union, the need to comply with the applicable legislation of the Eurasian economic Union and the legislation of the Russian Federation governing the procedure for moving through customs border of the Eurasian economic Union and the state border of the Russian Federation of alcoholic production and (or) tobacco products in order to avoid violations of the specified order, and prevent crimes associated with such movement.
