The Federal Customs Service of Russia informs: from April 1, amendments to the Criminal Code of the Russian Federation, correcting liability for smuggling

The FCS of Russia informs of the entry into force on April 1, 2024 of Federal Law No. 43-FZ of March 11, 2024 and Resolution No. 542 of the Government of the Russian Federation of March 31, 2022 (as amended by Resolution No. 324 of the Government of the Russian Federation of March 1, 2023), according to which the norms of the Criminal Code of the Russian Federation and the Criminal Procedural Code of the Russian Federation regulating the issues of responsibility for unlawful acts related to smuggling of certain categories of goods, as well as the competence of customs authorities in terms of preliminary investigation are clarified

So, from the specified date for the illegal movement across the customs border of the EAEU and the state border of the Russian Federation with member states of the EAEU of alcohol and tobacco products worth 100 thousand rubles will be established criminal liability under Article 226.1 of the Criminal Code of the Russian Federation. Article 200.2 of the Criminal Code of the Russian Federation is recognized as invalid

Customs authorities are also empowered to fully investigate by sending to the courts criminal cases on smuggling of strategically important goods and resources, cultural values, especially valuable wild animals, aquatic biological resources, plants, as well as mushrooms belonging to species listed in the Red Book of the Russian Federation and (or) protected by international treaties of the Russian Federation, their parts and derivatives
