A company will pay a fine of over a million rubles for failing to fulfill its obligations under a foreign trade contract

The exporter of wild fruits failed to ensure fulfillment of obligations under a foreign trade contract worth 43.5 million rubles. The violation of currency legislation was revealed by Nakhodkinsk customs.

Customs officers found that a firm from Primorye signed a foreign trade contract with a Chinese company for the export of goods worth 43.5 million rubles. In fulfillment of the contract, the company exported almost 2 tons of pine nuts (in shell) in different batches in 2021-2022. A total of 76 goods declarations were submitted to the customs authority.

The exporter had to ensure the fulfillment of obligations under the contract by one of the ways allowed by Russian legislation: to ensure the receipt of funds to its bank accounts, to make a cash payment, to conclude an agreement between the parties to replace the initial monetary claim with another obligation, etc. However, the expiry of the period established by the foreign trade agreement was not reached. However, the obligations were not fulfilled after the expiration of the term established by the foreign trade contract

Nakhodka Customs initiated 57 administrative cases against the Primorsky company (including 28 administrative cases against the head of the company) under Part 4.3 of Article 15.25 of the Administrative Offenses Code of Russia (failure of a resident to fulfill or terminate obligations under a foreign trade contract in due time). The company was given an administrative   penalty in the form of a fine in the amount of 1.37  million rubles.
