Chelyabinsk customs officers have additionally charged the budget 4 million rubles

Four million rubles was not paid to the federal budget by a firm engaged in the supply and installation of imported equipment for various industries. In the declaration, the entrepreneur indicated an inaccurate code of goods, which led to underpayment of customs duties

Chelyabinsk customs officers discovered the evasion scheme during a desk customs audit. Having studied the mechanism of the equipment, it turned out that the metal-cutting machine belongs to a different commodity item and is subject to duty at the rate of 7% and VAT at the rate of 20% of the customs value. Chelyabinsk Customs notified the organization of the amount of additional customs charges in the amount of 4 million rubles

The organization’s representative appealed to the arbitration court with a petition to recognize the decisions as illegal. However, the court sided with the customs. the 4 million was recovered and additional tax was charged to the federal budget.

“In order to avoid similar situations, declarants should take a more responsible approach to the issue of determining the commodity code.
