The Kemerovo customs: more than 31 million rubles derived for the border under the guise of buying imported equipment

Kemerovo customs officers revealed a fraudulent scheme: under the guise of buying expensive equipment overseas, displayed more than 31 million rubles. In respect of the organization and its unscrupulous managers administrative proceedings are under way.

The participant of foreign trade activities on the territory of the Kemerovo region, has signed four fictitious contract for the purchase of equipment. Nonresidents were made by organizations from China. The total amount of the four transactions – more than 31 million rubles.

So, the contracts become part of the technological equipment, and their purpose was not designated, and the rights and obligations of the parties spelled out formally. The algorithm of actions in case of failure of delivery was generally not provided.

Against violators prosecuted under part 5 of article 15.25 of the Russian code of administrative offences (Failure to comply with the resident within the established period duties on return to the Russian Federation the money paid to non-residents for not received in the Russian Federation the goods). The organization faces a fine in the amount from three quarters to one amount of the funds not returned to the Russian Federation.
