Section XI. TEXTILE MATERIALS AND TEXTILE PRODUCTS (groups 50-63)
this Section is exclusive of:
bristle or animal hair for broom manufacturing (commodity item 0502); horse hair or its waste (commodity item 0503);
human hair or ware manufactured of human hair (commodity items 0501, 6703 or 6704), with exception of filter cloth, usually applied in presses for oil extraction or for similar purposes (commodity item 5911);
lint cotton or other materials of vegetable origin specified in group 14;
asbestos specified in commodity item 2524 or products manufactured of asbestos or other materials specified in commodity items 6812 or 6813;
products specified in commodity items 3005 or 3006 (e.g., absorbent cotton, medical gauze, bandaging material and similar ware for medical, surgical, stomatological or veterinary purposes, sterile surgical suture materials); dental flosses (dental silk) in individual packages for retail distributition specified in commodity item 3306;
sensibilized textile materials specifies in commodity items 3701 - 3704;
monofilaments with crosscut dimension more than 1 mm or flat threads or similar forms (e.g., rayon straw) more than 5 mm wide manufactured of plastics (group 39), or basketry, or fabrics, or other basketry or wickered ware manufactured of monofilaments or flat threads (group 46);
fabrics, stockinets of machine or hand knitting, felting or felt or nonwovens, impregnated, coated or doubled by plastics, or products manufactured of them specified in group 39;
fabrics, stockinets of machine or hand knitting, felting or felt or nonwovens, impregnated, coated or doubled by rubber or products manufactured of them specified in group 40;
skins with pelage (group 41 or 43) or products manufactured of natural fur, fur fabric or products manufactured of them specified in commodity items 4303 or 4304;
textile ware specified in commodity items 4201 or 4202;
commodities or products of group 48 (e.g., cellulose cotton);
footwear or footwear parts, gaiters or hoggers or similar ware specified in group 64;
hair-nets or headwear or headwear parts specified in group 65
textile materials with abrasive coating (commodity item 6805), as well as carbonic fibers or wares manufactured of them specified in commodity item 6815;
fibreglass or fibreglass wares, with exception of embroidery by glass filament with visible ground-color (group 70);
products of group 94 (e.g., furniture, bedding, lamps and lighting equipment);
products of group 95 (e.g., toys, games, sporting inventory and nets);
products of group 96 (e.g., brooms, travel sewing sets, zip fasteners and typewriter ribbons); or
products of group 97.
2A. Commodities included in groups 50 - 55 or commodity items 5809 or 5902 and composed of combination of two or more textile materials, should be classified according that material which is weight prevalent as against any other textile material in this product.
Unless there is no one textile material of weight prevalence such products should be classified according that textile material, which is included in commodity item, last in ascending order of codes among concerned commodity items.
2B. In application of the foregoing rule:
horsehair gimp yarn (commodity item 5110) and metallized thread (commodity item 5605) should be considered as integrated textile material, which weight is considered as grand total of all its components weights; while classifying of fibers metallized thread should be considered as textile material;
while selecting proper commodity item first of all group should be identified, and than corresponding commodity item within this group should be identified, ignoring materials which are exclusive of that group;
while both groups 54 and 55 linked with any other group, they should be considered as integrated group;
while group or commodity item include commodities of different textile materials, such materials should be considered as integrated textile material.
2C. Foregoing provisions of Notices 2A and 2B, are applicable also in classifying of yarn noted below in notice 3 (A B), 4 (A, B), 5 or 6.
3A. Within this Section subject to exceptions, specified below in notice 3B, yarns (single, cabled (twisted) or one-ply), described below, should be considered as " strings, cordage, ropes and hawsers":
manufactured of silk threads or silk waste of titer more than 20 000 dtex;
manufactured of chemical threads (including threads manufactured of two or more monofilaments specified in group 54) of titer more than 10 000 dtex;
manufactured of hemp or flax fibers:
glazed of titer 1429 dtex or more; or
ii) unglazed, of titer more than 20 000 dtex;
manufactured of three or more times folded coconut fiber;
manufactured of other vegetable fibers of titer more than 20 000 dtex; or
reinforced by metal filament.
yarn of wool or of other fibers of animal origin and paper yarn, with exception of yarn, reinforced by metal filament;
bundle of chemical threads of group 55 and complex filament without twisting or with twisting less than 5 twists per one meter of group 54;
fiber of silkworm fibroin under commodity item 5006 and monofilament of group 54;
metallized threads under commodity item 5605; yarn reinforced by metal filament included in accordance with Notice 3A (f), specified above; and
chenille yarn, gimp yarn and fashioned loop yarn under commodity item 5606.
4A. in groups 50, 51, 52, 54 and 55 subject to exclusions, stipulated below in Notice 4B, the term "prepacked for retail distributition" means yarn (single, cabled (twisted) or one-ply):
spooled on paper plates, coils, bobbin tubes or similar carriers, of weight not more than (including weight of carrier):
85 g - for silk threads, silk waste or chemical threads; or
ii) 125 g - for other yarn;
in clews, raps or sleaves of weight not more than:
85 g - for chemical threads of titer less than 3000 dtex, silk threads or silk waste ;
ii) 125 g - for other yarn of titer less than 2000 dtex; or
iii) 500 g - for other yarn;
in raps or sleaves, including smaller raps or sleaves, divided by threads, which made them independent, at that each of these smaller raps or sleaves has the weight not more than:
85 g - for silk threads, silk waste or chemical threads; or
ii) 125 g - for other yarn.
one-ply yarn of any textile material apart from:
one-ply unbleached yarn of wool or of animal fine hair; and
ii) one-ply yarn of wool or of animal fine hair, bleached, pigmented or printed, of titer more than 5000 dtex;
cabled (twisted) or one-ply yarn, unbleached:
of silk threads or silk waste, prepacked; or
ii) of other textile material, with exception of yarn of wool or animal fine hair, ;
cabled (twisted) or one-ply yarn of silk threads or silk waste, bleached, pigmented or printed, of titer 133 dtex or less; and
one-ply, cabled (twisted) or one-ply yarn of any textile material:
in raps or sleaves of cross-winding; or
ii) reeled on carriers or otherwise indicating to its usage in textile industry (e.g., in wood particle boards, on torsion mounts and spools, in conic bobbin or cone pins or in form of cocoons for embroidery machines).
in commodity items 5204, 5401 and 5508 the term "sewing threads" means cabled (twisted) or one-ply yarn or one-ply yarn:
reeled on carriers (e.g., spools, torsion mounts) of weight (including weight of carrier) not more than 1000 g;
dressed for usage as sewing threads; and
with final right-way twist.
in this Section the term " high strength yarn" means yarn with relative breaking load, measured in sN/tex (santinewtons per one tex), exceeding:
- one-ply yarn of nylon or of other polyamides or polyesters - 60 sN/tex;
- cabled (twisted) or one-ply yarn of nylon or of other polyamides or polyesters - 53 cN/tex;
- one-ply, cabled (twisted) or one-ply yarn of viscose fibers - 27 sN/tex.
in this Section the term "ready-made" means:
cut, but not in form of quadrates rectangles;
presented in finished form, usable for utilization (or requiring only division by cutting-off separating threads) and not requiring sewing together or other treatment (e.g., napkins, towels, tablecloths, neckerchiefs, blankets);
hemstitched or with hemded edges or with nubby fringe longwise any edge, but excluding woven fabrics, having cut rims prevented against fall by whip or by other simple method;
dimensionally cut and with rims treated by plucking of threads;
sewed together, glued or jointed by other method (except pieceworks, consisting of two or more strip panels of identical material, sewed together as edge joint, and pieceworks, consisting of two or more textile materials, combined layer by layer, with or without soft layer);
knitted by machine or hand method according form, represented in form of separate ware or in form of several jointed ware.
in groups 50 - 60:
groups 50 - 55 and 60 and unless otherwise contextually specified, groups 56 - 59 are exclusive of commodities are ready-made as it is specified above in Notice 7; and
group 50 - 55 and 60 are exclusive of commodities of groups 56 - 59.
Clothes of groups 50 - 55 include clothes, consisting of layers of parallel threads, located one over another on sharp or right angle. These layers fastened together in thread crossing points with bonding agent or thermal bonding.
Elastic ware, consisting of textile materials in combination with runner threads are included in this Section.
in this Section the term "impregnated" means also treatment by method of immersion .
in this Section the term "polyamides" includes also "aramids".
Unless otherwise contextually specified, garments manufactured of textile materials, relative to different commodity items, should be included in corresponding commodity items, even if they represented in sets for retail distributition. In this Notice the term " garments manufactured of textile materials" means garments, named in commodity items 6101 - 6114 and 6201 - 6211.
Notices to commodity sub-items :
in this Section and where applicable in entire Nomenclature the following terms mean:
a. elastic thread:
complex thread, including monofilament manufactured of synthetical textile materials, other than textured thread, which not break under triple stretching as against its primary length and which under double stretching as against its primary length during period of 5 minutes returns to length, not more than one and half exceeding its primary length.
b. unbleached yarn:
yarn, having natural color of creating fibers and not exposed to bleaching, dyeing (in pulp or otherwise) or printing; or
ii) having indefinite color ("greige yarn"), manufactured of picked raw materials.
Such yarn may be treated by colorless textile size or unstable pigment (disappearing after simple washing with soap), and in case of chemical fibers - treated in pulp with delustering agent (e.g., titanium dioxide).
c. Bleached yarn:
passed bleaching process, manufactured of bleached fibers or, unless otherwise contextually specified, pigmented in white color (in pulp or otherwise) or treated with white textile size;
ii) consisting of composition of unbleached and bleached fibers; or
iii) cabled (twisted) or one-ply yarn, consisting of unbleached and bleached threads.
d. Color (pigmented or printed) yarn:
pigmented (in pulp or otherwise) in color, another than white or of unstable color, or printed or manufactured of pigmented or printed fibers;
ii) consisting of combination of pigmented fibers of different colors or of combination of unbleached or bleached fibers with pigmented fibers (yarn manufactured of bicolour roving or melange yarn) or printed yarn of one or several colors with intervals for imitation of points;
iii) manufactured of printed ribbon or roving; or
iv) cabled (twisted) or one-ply yarn, consisting of unbleached or bleached yarn and pigmented yarn.
Foregoing definitions are also usable in relevant correcting, toward monofilaments and flat or similar threads of group 54.
c. Unbleached clothes:
manufactured of unbleached yarn and not exposed to bleaching, dyeing or printing. Such clothes may be exposed to colorless dressing or dyeing by unstable pigments.
d. Bleached clothes:
bleached or, unless otherwise contextually specified, pigmented in white color or treated by white textile size, in piece;
ii) manufactured of bleached yarn; or
iii) manufactured of unbleached and bleached yarn.
e. Pigmented clothes:
plain clothes, with exception of pigmented in white color (unless otherwise contextually specified), or exposed to color glazing, except white color (unless otherwise contextually), in piece; or
ii) manufactured of monotone pigmented yarn.
f. Clothes of yarn of different colors (except printing clothes):
manufactured of yarn different colors or yarn different tinctures of one colors (except natural color of components of its fibers);
ii) manufactured of unbleached or bleached yarn and pigmented yarn; or
iii) manufactured of bicolor or melange yarn.
(Unexceptionally threads, forming rim or edge of cloth are ignored).
i. Printed clothes:
clothes, printed in piece, whether they manufactured of yarns of different colors or not.
(To printed clothes belong also clothes with picture, applied, e.g., by brush or spray, by stencil, by flocking method or by batik method).
Mercerization do not affect a classification of yarns or clothes according foregoing definitions.
Definitions, specified above in Notices to commodity sub-items 1e - 1i, while doing corresponding corrections are applicable to stockinets of machine or hand knitting.
j. Calico weave clothes:
clothes, in which structure every weft threads alternatively go over and under successive haircloth threads and every haircloth thread alternatively go over and under successive weft threads.
2A. Products of groups 56 - 63, having two or more textile materials, are considered as ware, entirely consist of that textile material, which according Notice 2 to this Section should be chosen for attribution of ware, consisting of the same textile materials, to groups 50 - 55 or commodity item 5809.
2B. While using foregoing rule:
when applicable, should be taken into account only part, determining classification in accordance with Principal rule 3 of interpretation;
background cloth is ignored, if textile product consist of background clothe and has piled or loopy surface;
in case of embroideries specified in commodity item 5810 and commodities manufactured of them the background cloth only should be taken in account. However embroidery without visible background and commodities manufactured of it should be classified exclusively according nun's threads.
